Terms of Service
1. Who we are and acceptance
MuginLabs is a platform of AI agents for WhatsApp operated by BLACOFI S.A.S. (Tax ID 902081282-9, Pereira, Risaralda, Colombia). By creating an account, purchasing a plan or using the platform, you accept these Terms of Service and our Privacy Policy. If you act on behalf of a company, you represent that you have authority to bind it.
2. The service
MuginLabs lets businesses connect their WhatsApp Business number to an AI agent that handles conversations using the context the business configures: product catalog, payment methods, human team and documents. The agent may answer questions, register orders, appointments, leads and tickets, and hand conversations to team members. Features depend on the purchased plan.
3. Accounts and eligibility
- The service targets businesses and merchants, not end consumers.
- You must be 18+ and provide accurate information.
- You are responsible for your credentials and all activity under your account.
4. Acceptable use
You agree NOT to use the platform to:
- send spam or unsolicited messages, or violate WhatsApp Business and Meta policies;
- conduct illegal or deceptive activities or infringe third-party rights;
- process your customers' personal data without the authorizations required by applicable law;
- attempt to breach platform security or access other customers' data.
Violations may lead to suspension or termination.
5. WhatsApp and Meta
The service runs on Meta's WhatsApp Business Platform. Availability and messaging rules depend on Meta and may change beyond our control. Unless your plan states otherwise, Meta's charges for WhatsApp conversations are paid by your company directly to Meta. You must comply with WhatsApp Business policies at all times.
6. Artificial intelligence
Agent replies are generated with AI models from specialized providers. Although the agent answers with your business data, it may make mistakes or omissions; you are responsible for supervising its operation, keeping your context up to date and handling cases that require human judgment. We do not use your customers' conversations to train our own AI models.
7. Personal data
Personal data processing is governed by our Privacy Policy. Regarding your end customers' data, your company acts as controller and MuginLabs as processor.
8. Plans, payments and billing
- Plans are charged in advance in Colombian pesos (COP) plus VAT, via recurring billing through the Wompi gateway.
- Each plan includes a monthly quota of AI-generated replies and limits on bots, documents and records; upon reaching it, the service may pause or notify you depending on plan settings.
- We issue electronic invoices under DIAN regulations.
- Prices may change; changes are notified with reasonable notice and apply from the next billing cycle.
- Non-payment may lead to suspension after the corresponding retries and notices.
9. Intellectual property
The platform, its software, brand and design belong to BLACOFI S.A.S. or its licensors. Your content (catalog, documents, business data) remains yours; you grant us a limited license to process it solely to provide the service.
10. Availability and support
We aim for high availability, but the service is provided “as is” and may be affected by maintenance, third-party failures (Meta, cloud or AI providers) or force majeure. Support is provided through the channels indicated in the platform.
11. Limitation of liability
To the maximum extent permitted by law, BLACOFI S.A.S.'s total liability arising from the service is limited to the amounts paid by your company in the three (3) months prior to the originating event. We are not liable for lost profits, data loss attributable to third parties, or business decisions made based on agent replies.
12. Termination
You may cancel your plan at any time; cancellation applies at the end of the paid period. We may suspend or terminate accounts that breach these terms. Upon termination you may request data deletion under the Privacy Policy.
13. Changes to these terms
We may update these terms; the current version will be published on this page and substantial changes notified through registered channels. Continued use implies acceptance.
14. Governing law and contact
